Short Addendum to License to Occupy
This addendum relates to a Licence To Occupy (the ‘Agreement’) entered into between the relevant operating company as ‘Grantor’ and you as ‘Licensee’.
As part of the Agreement, provision 2.5.3 states:
‘The Licensee is at liberty to find a replacement Licensee to take over the obligations and liabilities of this Agreement. In the event that the Licensee does find a suitable replacement Licensee, which replacement Licensee will be subject to the Grantor's approval, then the Licensee will be responsible for the License Fee on the Accommodation until the suitable replacement Licensee has agreed and signed a new Occupation agreement to take over the Occupation and has taken occupation. In any event, the Licensee will remain liable for all License Fee and other charges under this Agreement which exceed the amount of License Fee which a replacement Licensee agrees to be liable for under a new License to Occupy.’
Notwithstanding the provisions of 2.5.3. the Grantor and the Licensee hereby further clarify as follows:
Following commencement of the Occupation Period (i.e. once the Licensee is occupying the Accommodation), the Licensee must notify the Grantor in writing of their intentions BEFORE vacating the Accommodation and/or agreeing to allow any third party to take over the obligations of the Licensee under the Agreement (whether by formal agreement or informal arrangement).
The Grantor will acknowledge any such request and inform the Licensee of the process at that time.
The Licensee shall not under any circumstances advertise or promote the availability of the Accommodation on any website, listing site, or through any agent prior to confirmation of the process from the Grantor following a request to assign the Agreement and/or hand over the Accommodation.
The Grantor shall offer its reasonable support and assistance to facilitate the assignment of any remaining rights and responsibilities under the Agreement to a new licensee.
In all other respects, the full terms of the Agreement remain the same.

This summary guidance is intended to remind all residents living in Vita Student accommodation of their responsibilities, how to avoid hazardous situations and how to act when an emergency arises. By following these general principals hazards can be significantly reduced:
- Turn off stoves and all other heated and electrical appliances in the apartment when not in use
- When leaving your flat, always ensure electrical appliances are switched off
- You should not attempt to repair faulty electrical equipment. Report any problems to the Vita Student Management Team
- Petrol, paraffin or other highly flammable liquids and materials - including candles - are strictly forbidden in Vita Student accommodation.
- Report all health and safety hazards to Vita Student Management Team as soon as you discover them.
- Personal electrical appliances/equipment must be in a safe condition. Vita Student has a "Smoke Free" policy. Smoking is not allowed in any part of the building.
Fire Safety:
All studio apartments are fitted with HEAT detectors which will be activated by the heat from a fire (not from cooking), and SMOKE detectors which will be activated by cooking and cigarette smoke.
Emergency Arrangements:
It is important that residents follow the procedures laid down by Vita Student for emergencies. The actions to take in the event of a fire are shown on fire notices, which are posted at strategic points in all apartments. It is essential that you take time to read and understand these. It is each individual student’s responsibility for complying with local emergency arrangements. All residents must comply with the following to minimise the risk of injury and damage to property:
- Residents should be familiar with the position of fire alarms and fire exits.
- It is a criminal offence to misuse any fire safety equipment, including extinguishers, alarms, detectors, sounders and fire blankets. Any person found doing so will be liable to a disciplinary, a legal charge and possible eviction.
- All corridors and exits must be kept clear at all times.
- All fire or smoke doors in studios and corridors must be kept closed and never wedged open.
- NEVER use a lift as a means of escape in an emergency. Always use the staircase and follow the emergency exit signs.
Priority Actions in a Fire Situation:
- Keep calm
- Call the Fire Brigade. Do not delay. Dial 999
- Inform the Vita Student Management Team
- If - and only if - the fire is small and obviously contained (for example, in a small pan) smother it using the fire blanket supplied. Always make sure you have a means of escape behind you.
- The golden rule is: WHEN IN DOUBT - GET OUT
Actions if you hear a Fire Alarm in apartment or room that you are in:
- Never delay leaving the building when the alarm sounds.
- Leave the building by the nearest available exit
- Do not re-enter the building until you are told it is safe to do
Fire Fighting Equipment and its safe use:
- Fire blankets can be used to smother small appliances that are on fire (for example, pots and pans in kitchens) and also to wraparound a person whose clothes are alight.
- Once you have used a blanket for whatever purpose, do not remove it until you are sure it is safe to do so. If it is removed too soon the burning substance will re-ignite. If it has been used to wrap around someone on fire, leave it wrapped around them as it acts as a temporary dressing until the ambulance arrives.
- With all types of fire fighting equipment it is essential to read the instructions for use. A few seconds spent doing this can save a great deal of confusion in an emergency.
Electrical Safety:
- Residents are forbidden to carry out any work which might give rise to a danger of electrocution. This includes the repair or adjustment of electrical appliances and connecting defective/dangerous appliances to the mains. The use of electrical radiant or blow heater electrical appliances in student apartments is prohibited. To do so contravenes electrical safety standards and fire regulations throughout Vita Student accommodation.
- Residents using personal electrical appliances should regularly check for defects, and in particular look for:- Broken plugs- Frayed, chafed or split supply cables- Signs of overheating, for example, scorch marks, blackening or blistering, plug warm to the touch- Dangerous connections at the appliance and plug ends of the cable - Rattling or looseness in the plug or appliance which might indicate an internal fault
Visitors:
Vita Student is responsible for the health and safety of all visitors to any Vita Student accommodation premises. It is the individual student’s responsibility to acquaint their guests with the health and safety arrangements for the building and ensure that they observe the rules. In the event of a fire or other emergency which might necessitate evacuation of the student accommodation, it is essential that residents can account for their visitors and are responsible for them at all times.
Bikes Disclaimer
Vita Student bikes may only be used by Residents of Vita Student.
Bikes may only be borrowed for a maximum loan period of 24 hours at any one time.
Any bike borrowed by a Resident may only be used by that particular Resident.
Residents must return the bike in the same condition as originally borrowed to the residence bike store.
Residents must sign in the bike lock key and both front and rear lights to the reception desk immediately upon return.
Residents will be liable for the cost of repair or replacement should the lights or lock key be lost or damaged.
Maintenance:
The bikes are checked and maintained so as to be in roadworthy condition on a planned preventative basis at monthly intervals. Users must not under any circumstance take a cycle out in the knowledge that a fault is present.
Brakes, lights, tyres and free movement of wheels and pedals must be checked by the user before commencing use.
All faults must be reported immediately by the user to Reception, either upon initial inspection by the user or at any time subsequently as soon as the user becomes aware of a fault.
Security and Insurance:
The bikes are insured for theft as long as properly secured using the Magnum Plus Magsolid Shackle lock provided by Vita Student .Should a bike be stolen whilst secured by any other means then the Resident will be liable for the full cost of replacement.
The bike must be fully locked to a secure cycle parking stand, whenever left unattended. The bike must be locked through both frame and wheel with the above lock.
If a bike is stolen, the Resident must report this immediately upon becoming aware of this to their Vita Student residence.
Users of Vita Student bikes shall abide by the Highway Code at all times.
Residents have a duty to report any damage or faults relating to the cycles immediately, so that they can be maintained in a roadworthy condition.
If any damage is sustained to a bike while in the possession of a user (beyond reasonable wear and tear) then the user will reimburse to Vita Student on demand the cost of any repair required and shall be invoiced accordingly Vita Student.
Vita Student advises the use of a properly fitting bike helmet at all times.
Vita Student shall not be liable for any injury or loss whatsoever in relation to use or loan of a bike, except in relation to death or personal injury arising from Vita Student’s negligence. Any injury or loss resulting from or arising in connection with the reckless, careless or improper use of a Vita Student bike by a user shall be borne by such Resident.
TV Licence Disclaimer
A TV Licence is a legal permission to install or use television receiving equipment to watch or record television programmes as they are being shown on TV or live on an online TV service, and to download or watch BBC programmes on demand, including catch up TV, on BBC iPlayer. Vita Student does not provide a TV licence and always advises that residents are responsible to become covered by a TV licence if they- watch or record live TV programmes on any channel- download or watch any BBC programmes on iPlayer live, catch up or on demand. This applies to any provider they use and any device, including a TV, desktop computer, laptop, mobile phone, tablet, games console, digital box or DVD/VHS recorder. If you do not require a TV licence then you must also declare this to TV Licensing via their online service.
Gym Disclaimer
Vita Student provides an unmanned and unsupervised gym facility for the exclusive use of residents. Guests are not permitted to use the facilities.
Vita Student always advises that residents should always consult their doctor or other healthcare provider before changing their diet or starting an exercise program.
Waiver and Release: In consideration for entering the gym and exercising or using any of the facilities and equipment, every Vita Student resident understands that they are aware of the inherent risks that come with using a gym, and accepts that they are using the gym entirely at their own risk.
Each resident also accepts and assumes full responsibility for any and all injuries, losses and damages that they incur while attending, exercising or participating in the Vita Student Gym. Having been provided with these terms of use prior to using the gym, each Vita Student resident waives all and any claims, demands, damages, causes of action whether known or unknown against Vita Student, Vita Student Management or the landlord which may arise from the residents’ use of the gym facility or its equipment.
