PRIZE COMPETITION TERMS AND CONDITIONS

These main terms and conditions apply to all prize competitions organised by or on behalf of Vita Student Management Limited, a company registered in England and Wales with company no. 08540975, whose registered office is at Horseshoe Farm, Elkington Way, Alderley Edge, England, SK9 7GU (“Vita Student”).

Vita Student is the promoter of the prize competition (the “Competition”). By entering a Competition, you agree to be bound by these terms and conditions and Vita Student reserves the right to remove, temporarily suspend or refuse any entry or award any prize to anyone in breach of these terms and conditions.

Promotional materials relating to the Competition, including all information on how to enter (including via Vita Student’s website or social media accounts if applicable), also form part of these terms and conditions (each being the “Special Terms and Conditions”). In the event of any conflict between any Special Terms and Conditions referred to in such promotional materials and these terms and conditions, the Special Terms and Conditions shall take precedence.

  1. Entering the Competition
    • The Competition opening and closing date will be specified within the Special Terms and Conditions (the “Competition Period”). All Competition entries must be received by Vita Student during the Competition Period. All Competition entries received outside of the Competition Period will be void.
    • Entries received which are not submitted via the official entry method will not be accepted. Use of script, macro or any automated system to enter the Competition is prohibited and entries made (or which appear to have been made) using any such system may be treated as void by Vita Student. Any illegible, incomplete or fraudulent entries will be rejected.
    • Vita Student will not accept: (i) responsibility for Competition entries that are lost, mislaid, incorrectly uploaded, damaged or otherwise delayed, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or (ii) proof of transmission or postage as proof of receipt of entry to the Competition.
    • Entrants may make a maximum of one entry per person during the Competition Period. Entries on behalf of another person will not be accepted and joint submissions are not allowed unless otherwise specified. Entrants may only win one prize per person, irrespective of the number of entries submitted.
    • Where applicable, Competition entries will be judged by an independent panel (being individuals who have not entered the Competition or otherwise been involved in its administration and who are not related or otherwise personally associated with an entrant). The decision of the panel of judges (acting reasonably) will be final. Vita Student will provide the names of the judges to anyone who requests such information in writing within one month of the Competition Period ending.
    • Entrants can withdraw from the prize competition at any time by providing written notice to marketing@vitastudent.com
  2. Eligibility
    • Entrants must be 18 years or older and a resident in the United Kingdom only.
    • Entrants must not be: (i) an employee or agent of Vita Student (or any of its group companies); or (ii) otherwise associated with the administration of the Competition, or be an immediate family member of such persons.
    • In entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. Vita Student may require you to provide proof that you are eligible to enter the Competition and reserves the right to use reasonable measures to check that you are eligible if such information is not provided by you within a reasonable timeframe.
    • Vita Student will not accept Competition entries that are:
      • automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
      • completed by third parties or in bulk;
      • illegible, have been altered, reconstructed, forged or tampered with;
      • photocopies and not originals; or
    • Vita Student reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition.
  3. The prize
    • Prizes are subject to availability. There is no cash alternative for the prize and the prize is not negotiable, transferable, or exchangeable.
    • Vita Student reserves the right to replace the prize with an alternative prize of a similar nature and an equivalent value if circumstances beyond Vita Student’s control makes it necessary to do so or if Vita Student decides in its reasonable discretion that it is appropriate to do so.
    • Where a prize includes a monetary amount, gift card or voucher (or similar), such prize will be for a pounds sterling amount (or local currency equivalent). Vita Student, the prize provider or the issuer gift card and their agents reserve the right to refuse to accept gift cards which are deemed to have been tampered with, defaced, duplicated, damaged or which otherwise are suspected to be affected by fraud or which have been lost or stolen following delivery.
    • Prize winners are responsible for paying all associated costs that are not specifically stated in any promotional materials or Special Terms and Conditions, including (where applicable) transport, accommodation, meal costs, spending money, insurance and all other incidental expenses.  Winners are also personally responsible for any personal or incidental expenses and any VAT, national and/or local tax liabilities incurred in claiming or using the prize.
    • By participating in the Competition, entrants agree that the prize is awarded on an “as is” basis, and that neither Vita Student nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prize.
  4. Winner announcement and claiming the prize
    • Unless otherwise stated in the Special Terms and Conditions, winners (and runners up if applicable) will be notified by email or using the other contact details provided to the Vita Student within 14 days after the end of the Competition Period.
    • Unless otherwise stated in the Special Terms and Conditions, winners will be required to confirm acceptance of the applicable prize within 14 days of having been notified. If the winner has not claimed their prize by the date specified or the winner refuses or is unable to provide eligible details for receipt of their prize, Vita Student reserves the right to award the prize to another entrant.
    • Vita Student are obliged to publish or make available information that indicates that a valid award took place. To comply with this obligation Vita Student may either publish or make available certain information about prize winners (including the name and location of prize winners). If you object to this information being published or made available, please contact Vita Student at marketing@vitastudent.com. In such circumstances, Vita Student must still provide the information and winning entry to the Advertising Standards Authority on request.
    • Vita Student does not accept any responsibility if you are not able to take up the prize.
    • The prize may not be claimed by a third party on your behalf.
    • Vita Student will notify the winner as to whether the prize will be delivered to or made available for collection by the winner.
  5. Limitation of liability

Entrants must not do anything illegal and/or dangerous and/or that would put themselves or others at any risk. Save where it has been negligent, the Promoter will not be responsible for any damage, loss or injury resulting from an entrant’s entry into the Competition or their acceptance and/or use of the prize. Nothing in these terms and conditions or the Special Terms and Conditions shall in any way limit Vita Student’s liability for death or personal injury caused by its negligence or for any other matter where liability may not be limited as a matter of law.

  1. Ownership of competition entries and intellectual property rights
    • All Competition entries and any accompanying material submitted to Vita Student will become the property of Vita Student on receipt and will not be returned.
    • By submitting your Competition entry and any accompanying material, you agree to:
      • assign to Vita Student all your intellectual property rights with full title guarantee; and
      • waive all moral rights,

in and to your Competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

By submitting your Competition entry and any accompanying material, you acknowledge that you have been expressly authorised to use the image and/or voice of any person appearing in your Competition entry and any accompanying material, and you agree to assign such image rights to Vita Student.

  • You agree that Vita Student may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and may also share your entry via other form of media (including social media platforms) in connection with any publicity of the Competition or otherwise.
  • To the extent that such rights have not been assigned in accordance with these terms and conditions, you agree to grant Vita Student a non-exclusive, royalty-free, worldwide, perpetual, irrevocable licence, for the full period of any intellectual property rights in the Competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Competition entry and any accompanying materials for such purposes.
  1. Data protection
    • Personal data supplied during the course of the Competition will only be processed as set out in our Privacy Policy: https://www.vitastudent.com/en/privacy-policy/ (and where applicable the Competition prize provider’s privacy policy) and in accordance with these terms and conditions.
    • By entering the prize competition, the entrant consents to their details being used in this way.
  2. General
    • If there is any reason to believe that there has been a breach of these terms and conditions, Vita Student may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
    • Vita Student reserves the right to hold void, suspend, cancel, amend or supersede the Competition (including altering the prizes) where it becomes necessary to do so.
    • These terms and conditions are governed by English law. The courts of England shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Competition or these terms and conditions.

  1. STYLE YOUR IDEAL ROOM (PRIZE COMPETITION SPECIAL TERMS AND CONDITIONS)

    Promoter

    1. The promoter is Vita Student Management Ltd, a company registered in England and Wales with company no. 08540975, whose registered office is at Horseshoe Farm, Elkington Way, Alderley Edge, England, SK9 7GU (“Vita Student”).

    Competition

    2. This is the Vita Student “Style Your Ideal Room” Competition (the “Competition”). By entering the Competition, you are in with a chance to win a re-styling of your bedroom for the academic year 2024/2025 with the assistance of Vita Student’s interior design team, subject to the terms and conditions set out below (the “Special Terms and Conditions”) together with Vita Student’s full competition terms and conditions.

    Entering the Competition

    3. By submitting a Competition entry, you are agreeing to be bound by the Special Terms and Conditions and the Main Competition Terms and Conditions. In the event of any conflict between the Special Terms and Conditions and the Main Competition Terms and Conditions, the Special Competition Terms and Conditions shall prevail. Vita Student reserves the right to refuse entry or refuse to award the prize to anyone in breach of the Special Terms and Conditions and/or the Main Competition Terms and Conditions.

    4. The Competition is free to enter and no purchase is necessary.

    5. Entrants must:

    a. be 18 years or older; and

    b. have entered into an accommodation agreement with Vita Student for the academic year 2024/2025 in respect of a room at a Vita Student building in the United Kingdom or Barcelona, Spain (each a “Vita Building”), under which the relevant cooling-off period relating to the accommodation agreement has expired; and

    c. not be in breach of any term of any existing current accommodation agreement (be it an accommodation contract for 2023/2024 or for 2024/2025).

    6. The Competition will run from 12:00pm BST on 06/05/2024 until 11:59pm BST on 23/05/2024 (the “Competition Period”). All entries received outside of the Competition Period will be automatically void.

    7. To enter the Competition, entrants must:

    a. “Follow” the Vita Student page on Instagram; and
    b. “Like” Vita Student’s post announcing the Competition; and
    c. Create and submit a mood board displaying the entrant’s ideal styling of their bedroom at the Vita Building for the academic year 2024/2025 (“Mood Board”) by either;
    I. sharing a story with a visual of their mood board on their Instagram profile, tagging @vitastudent
    II. sharing a visual of their mood board via Instagram Direct Message to @vitastudent

    8. Entrants must ensure that the content of their Mood Board is original and does not copy, in whole or in part, any third party’s designs or styles (including the use of any trade marks, logos, slogans or similar). However, in demonstrating the inspiration and ideas behind their Mood Board, it is acknowledged that Entrants may show details of brand designs and styles which have influenced the creation of their Mood Board.

    9. Entrants are permitted to submit multiple Mood Boards for the Competition provided that there are no duplicate Mood Boards submitted.

    10. Vita Student reserve the right to verify that the selected winner meets all of the eligibility criteria described in these Special Terms and Conditions.

    Winner of the Competition

    11. There will be 1 winner of the Competition chosen from the pool of eligible entrants based on the content of their Mood Board.

    12. The winning Mood Board will be selected by an independent panel of judges based on the following criteria:

    a. A clear theme shown visually that is easy to understand and develop by others

    b. A mix of product and inspirational imagery

    c. To show an understanding of what type of items could be incorporated within the given budget

    13. The winner of the Competition will receive the opportunity to style their bedroom at the relevant Vita Building for the 2024/2025 academic year, based on the winning Mood Board, with a budget of up to £3,000 for room furnishings and consultation guidance provided by Vita Student’s interior design team (the “Room Styling”).

    14. As part of the Room Styling process, the winner of the Competition will be required to attend:

    a. an initial consultation with Vita Student’s interior designers to discuss the winning Mood Board and any other ideas for the Room Styling, to be held remotely via video call; and

    b. at a later date to be agreed, a meeting in person with Vita Student’s interior design team at the relevant Vita Building for an experience day (“Experience Day”), during which Vita Student’s interior design team will:

    i. set out Vita Student’s plans for the Room Styling taking into account the winning Mood Board; and

    ii. work with the winner to create a list of furnishings to purchase for use in the Room Styling (“Furnishings”).

    15. Vita Student reserves the right to vary or modify the styles set out in the winning Mood Board.

    Furnishings

    16. All Furnishings are subject to: (i) availability; and (ii) the current Vita Student residence guidelines at the relevant Vita Building (“Residence Guidelines”) a copy of which is available upon request.

    17. The Furnishings shall be limited to the following items (all of which must be in accordance with the Residence Guidelines):

    i. soft furnishings;
    ii. dressings;
    iii. a new desk chair;
    iv. rugs;
    v. framed artwork; and
    vi. such other items as the Vita Student interior design team may agree.

    18. The total price paid by Vita Student for the Furnishings shall not exceed £3,000. Any excess amount will be borne by the winner at their sole cost.

    19. Vita Student cannot guarantee the timescales in which the Room Styling will be implemented, however Student will use reasonable endeavours to implement the Room Styling (by carrying out such decoration work or transferring the Furnishings to the relevant bedroom as has been agreed during the Experience Day) as soon as possible once the winner has moved into the relevant Vita Building in September 2024.

    20. Following the completion of the Room Styling, the ownership of and risk in and to the Furnishings shall pass to the winner.

    21. Following the termination or expiry of the winner’s accommodation agreement for the academic year 2024/2025, the winner will be permitted to remove the Furnishings at their own cost and expense. Vita Student shall not be responsible for the removal or onward transportation of the Furnishings.

    22. Third party terms and conditions may apply in relation to the Furnishings. If there are any defects with an item of Furnishing, the winner shall be required to contact the relevant manufacturer in respect of any warranty or guarantee period (and Vita Student will provide reasonable assistance in this regard to the extent that it is able to do so).

    Room Styling Conditions

    23. The Room Styling is subject to the Residence Guidelines, including, but not limited to, any restrictions on the alteration or modification of bedrooms set out in the Residence Guidelines.

    24. There is no cash alternative for the Room Styling and the Room Styling is not negotiable, transferable or exchangeable. Vita Student reserves the right to replace the Room Styling with an alternative prize of equal or higher value if circumstances beyond Vita Student’s control makes it necessary to do so.

    25. If the winner fails to comply with these Special Terms and Conditions, Vita Student reserves the right to select an alternative winner of the Competition.

    26. The winner shall co-operate with Vita Student’s reasonable requests relating to the Competition (including but not limited to the winner’s Experience Day) including for example, by way of a short post or video relating to the Competition which Vita Student shall be free to share on its website or other social media platforms.

    27. Vita Student will not be responsible for and does not accept any liability for any loss, cost or damage occurring in respect of or in connection with:

    a. the winner attending the Experience Day or taking up the opportunity of the Room Styling (including on behalf of its agents or distributors or that of their employees); or

    b. the winner choosing to reside in an alternative accommodation during the implementation of the Room Styling,

    except to the extent that such liability arises due to the negligent acts or omissions of Vita Student (or where such liability cannot be excluded as a matter of law).

    Privacy Policy

    28. Information submitted in relation to the Competition shall be processed as set out in Vita Student’s privacy policy.

    Governing Law and Jurisdiction

    29. These Special Terms and Conditions are governed by English law. Wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland, Northern Ireland or Spain, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

  2. WELLNESS RETREAT AND BUNDLE (PRIZE DRAW FULL TERMS AND CONDITIONS)

    2. This is the Vita Student “Wellness Retreat and Bundle”. By entering the Competition, you are in with a chance to win: (i) a trip to attend the 7 Day Free The Soul Advanced Yoga & Holistic Nutrition (Faro, Portugal) (the “Wellness Retreat”) and (ii) a bundle of wellness items (the “Wellness Bundle”) , subject to the terms and conditions set out below (the “Special Terms and Conditions”) together with Vita Student’s full competition terms and conditions.

    3. By submitting a Competition entry, you are agreeing to be bound by the Special Terms and Conditions and the Main Competition Terms and Conditions. In the event of any conflict between the Special Terms and Conditions and the Main Competition Terms and Conditions, the Special Competition Terms and Conditions shall prevail. Vita Student reserves the right to refuse entry or refuse to award the prize to anyone in breach of the Special Terms and Conditions and/or the Main Competition Terms and Conditions.

    4. The competition is free to enter and no purchase is necessary.

    5. This competition is only open to current residents of Vita Student (both residents at the UK and in Barcelona sites).

    6. Entrants must be: (a) 18 years or older; and (b) a resident in the United Kingdom or Spain and (c) must have either (ii) a current and existing accommodation agreement with Vita Student in the United Kingdom or Spain for the current (2023/2024) academic year; or (ii) entered into an accommodation agreement with Vita Student for the next academic year (2024/2025) in the United Kingdom or Spain under which the relevant cooling-off period relating to the accommodation agreement has expired.

    7. The Competition will run from 12:00pm on 02/04/2024 until 11.59pm on 18/04/24 (the “Competition Period”). All entries received outside of the Competition Period will be void.

    8. To enter the Competition, entrants must:

    a. “Follow” the Vita Student page on Instagram; and
    b. “Like” Vita Student’s post announcing the Wellness Retreat and Bundle Competition; and
    c. Comment with the favourite thing the entrant does for their wellbeing. This comment should be no longer than the maximum number of characters Instagram allows for one comment.

    9. Entrants are permitted to submit multiple entries for the Competition provided that there are no duplicate answers.

    10. There will be 1 winner of the Competition, chosen from the pool of eligible entrants.

    11. Please note that the winner of the Competition will be selected by a random draw performed by a computer process using verifiably random results on 19/04/2024. The winner will not be selected based on the Competition entries submitted pursuant to paragraph 8(c) above.

    12. Vita Student reserve the right to verify that the selected winner meets all of the eligibility criteria described in these Special Terms and Conditions.

    13. The winner of the Competition will receive:

    a. return flights from BLF, MAN or BCN to FAO Portugal (up to a maximum value of £600) (with all other travel arrangements being provided through the Wellness Retreat);
    b. attendance at the Wellness Retreat for:

    i. Dates: 19th – 25th August 2024 only.
    ii. Private single room; and

    c. the Wellness Bundle, comprising of:

    i. The White Company Calm Wellness Gift Basket
    ii. Unisex Hooded Ribbed Hydrocotton Robe
    iii. Neom Wellbeing Pod Mini – Essential Oil Diffuser In Black
    iv. Neom 24/7 Essential Oil Blends
    v. Apple AirPods Pro (2nd generation) with MagSafe Charging Case (USB‑C)
    vi. STANLEY QUENCHER H2.0 FLOWSTATE™ TUMBLER | 1.2L
    (the “Prize”).

    14. Each element of the Prize is subject to availability. There is no cash alternative for the prize and the prize is not negotiable, transferable or exchangeable. Vita Student reserves the right to replace the Prize with an alternative prize of equal or higher value if circumstances beyond Vita Student’s control makes it necessary to do so.

    15. The winner must be available to attend the Wellness Retreat on the dates specified above (19th – 25th August 2024). There is no option for alternative dates. If the winner cannot attend the Wellness Retreat or if travel for the Wellness Retreat has not been booked for these dates, Vita Student reserves the right to select an alternative winner of the Prize.

    16. Booking of the travel arrangements will be carried out directly by Vita Student at its sole discretion (following discussions in relation to the various arrangements with the winner). In the event that the total cost of the travel is less than £600, any balance will not be payable by Vita Student to the winner.

    17. Once the travel to attend the Wellness Retreat has been booked, any changes to the booking will be at the winner’s sole cost.

    18. Third party terms and conditions will apply in relation to: (i) the travel selected by the winner and any cancellation or changes requested (if applicable); and (ii) the terms and conditions of the Wellness Retreat provider can be found here.

    19. Where applicable, the winner must comply with and is responsible for attending to any inoculation and health regulations or passport or visa requirements for the destination. The winner will be responsible for ensuring that they have adequate travel insurance and documentation and Vita Student may require evidence that such requirements have been satisfied prior to issuing the Prize.

    20. Spending money, meals, travel taxes, travel insurance, passports, visas, vaccinations, inoculations, arranging and paying for travel to and from the departure airport or station, additional transfers or regional transport and all other ancillary costs (as well as obtaining any of these) not specified in the Prize description are the sole responsibility of the winner.

    21. The winner shall co-operate with Vita Student’s reasonable requests relating to the sharing of the winner’s experience in winning the Prize (including for example, by way of a short post or video relating to the Competition) which Vita Student shall be free to share on its website or other social media platforms.

    22. Vita Student will not be responsible for and does not accept any liability for any loss or damage occurring in respect of or in connection with the winner taking up the Prize (including on behalf of its agents or distributors or that of their employees) except to the extent that such liability cannot be excluded as a matter of law.

    23. Information submitted in relation to the Competition shall be processed as set out in Vita Student’s privacy policy.

    24. These Special Terms and Conditions are governed by English law. Wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland, Northern Ireland or Spain, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

  3. ONE YEAR FREE RENT (PRIZE DRAW FULL TERMS AND CONDITIONS)

By entering the Competition, you are in with a chance to win to win a year’s free rent at Vita Student Liverpool for the 2024/25 academic year, subject to the terms and conditions set out below (the “Special Terms and Conditions”) together with Vita Student’s full competition terms and conditions which can be found here: [hyperlink] (the “Main Competition Terms and Conditions”).

    3) By submitting a Competition entry, you are agreeing to be bound by the Special Terms and Conditions and the Main Competition Terms and Conditions. In the event of any conflict between the Special Terms and Conditions and the Main Competition Terms and Conditions, the Special Competition Terms and Conditions shall prevail. Vita Student reserves the right to refuse entry or refuse to award the prize to anyone in breach of the Special Terms and Conditions and/or the Main Competition Terms and Conditions.

    4) The competition is free to enter and no purchase is necessary.

    5) This competition is only open to current residents of Vita Student Liverpool.

    6) Entrants must:

    a) be 18 years or older; and
    b) have entered into an accommodation agreement for the academic year 2024/2025 at Vita Student Liverpool (5-7 Crosshall Street, Liverpool, L1 6DQ) under which the relevant cooling-off period relating to the accommodation agreement has expired; and
    c) not be in breach of any term of their current accommodation agreement.

    7) The Competition will run from 12:00pm on 05/03/2024 until 11.59pm on 21/03/2024 (the “Competition Period”). All entries received outside of the Competition Period will be void.

    8) To enter the Competition, entrants must:

    a) “Follow” the Vita Student page on Instagram; and
    b) “Like” Vita Student’s post announcing the “One Year Rent Free at Vita Student, Liverpool” Competition; and
    c) Answer the question: “What lives rent free in your head”. This description should be no longer than the maximum number of characters Instagram allows per comment.

    9) Entrants are permitted to submit multiple entries for the Competition provided that there are no duplicate answers.

    10) There will be 1 winner of the Competition, chosen from the pool of eligible entrants.

    11) Please note that the winner of the Competition will be selected by a random draw performed by a computer process using verifiably random results on 22/03/2024. The winner will not be selected based on the Competition entries submitted pursuant to paragraph 8(c) above.

    12) Vita Student reserve the right to verify that the selected winner meets all of the eligibility criteria described in these Special Terms and Conditions.

    13) The winner of the prize will have the cost of their room under their existing accommodation agreement paid for the 2024/2025 academic year (the “Prize”). If the winner of the Prize has already paid a proportion of the accommodation fee in advance, this will be refunded to them in GBP to a UK bank account of their choice. The Prize only includes the cost of the room under the winner’s existing accommodation contract and shall exclude any additional costs over and above the base cost of the room as detailed within the existing accommodation contract.

Entrants must only choose one of the five (5) multiple choice answers and Entrants will be disqualified if they comment with more than one answer choice or make multiple comments providing alternative answer choices.

    8) Vita Student has calculated the answer to the question based the following criteria:

    • The answer includes:
      • all dealt bookings over 26 weeks long across all academic years from 2013/14 up to and including academic year 2023/2024 up to midday Friday 10th November 2023; and
      • all bookings made through nominations agreements (being bookings made by language schools and other third-party booking partners).
    • The answer excludes:
      • all cancelled bookings; and
      • dual occupants to rooms.
    • Individuals who have re-booked with Vita Student for subsequent academic years are counted once for each year they occupied a room.

    9) The opening date for entries is 12pm on 1st December 2023. The closing date of the prize draw will be 23:59 on 29th December 2023. Entries received after this time will not be considered.

    10) Vita Student does not accept responsibility for entries that are not received for any reason, or any entries not successfully completed due to a technical fault (including technical malfunction, computer hardware or software failure or network or server failure) of any kind.

    The prize

    11) The winner will be notified by 30th November 2023 by direct message on Instagram. Vita Student reserves the right to require a winner to provide confirmation of their status as a resident or future resident at a Vita Student building by providing us with their VITA-REF before they can claim the prize, failure by an entrant to provide such confirmation within [2 days] will result in the entrant being ineligible to receive the prize. In this instance, the random draw will be repeated to produce a new winner.

    12) If the winner cannot be contacted or does not claim the prize within one (1) month after being notified, the winner’s prize will be forfeited and Vita Student reserves the right to withdraw the prize from the winner and draw a replacement winner in accordance with the process described above.

    13) Vita Student will arrange for the prize to be delivered to the winner’s Vita Student accommodation if they are a current resident. Future residents will receive the prize in their room upon check-in and arrival.

    14) In compliance with Regulation (EU) 2016/679, the General Data Protection Regulation, Vita Spain Management SLU, acting as the data controller, informs entrants that their personal data will be processed for the purpose of managing their participation in the draw, as well as preventing fraudulent entries and, if applicable, delivering the prize to the respective winner. The processing of entrants’ personal data will be carried out based on the execution of the present terms and conditions. Failure to provide the required personal data will make it impossible to participate in this promotion. Except for the necessary communication of the winner’s data to the entity responsible for awarding the prize or when communication must be carried out due to a legal obligation, participants’ personal data will not be disclosed to third parties. The retention period of the data will be determined by the contractual relationship and the time necessary to fulfil corresponding legal responsibilities. The data may be kept blocked for the period necessary for the formulation, exercise, or defence of claims, requests, legal and/or contractual responsibilities and obligations. Entrants may exercise their rights of access, rectification, opposition, limitation, erasure, portability, and not to be subject to automated decision-making by contacting marketing@vitastudent.com. Whenever they deem it appropriate, entrants may file a complaint with the Spanish Data Protection Agency (https://www.aepd.es ).

    15) Vita Student reserves the right to hold, void, cancel, suspend or amend the prize draw promotion where it becomes necessary to do so.

    16) Vita Student shall have the right, at its sole discretion and at any time, to change or modify these terms and conditions, such change shall be effective immediately upon posting to this webpage.

    17) Vita Student’s decision in respect of all matters to do with the prize draw shall be final and no correspondence will be entered into about it.

    18) You acknowledge that:

    1. the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.
    2. Instagram will not be responsible or liable for this promotion.

    19) Insofar as is permitted by law, Vita Student will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Vita Student its agents or distributors or that of their employees. Your statutory rights are not affected.

    20) The prize draw and these terms and conditions will be governed by Spanish law and in particular according to Decree 397/2011 of October 11, which approves the Regulation of raffles and random combinations for advertising or promotional purposes. Any disputes will be subject to the exclusive jurisdiction of the courts of the city of Barcelona.
